RIFT CHAT — USER AGREEMENT
Publisher: boganpanda.com
Agreement version: 1 — 28 October 2026

IMPORTANT POINTS — PLEASE READ FIRST

* Rift Chat is provided free of charge, "as is", "where is" and as available.
To the fullest extent permitted by law, you use it at your own risk.
* Bugs, outages, lost messages, failed updates and security failures can happen.
Keep independent backups and recovery keys. Do not rely on Rift Chat for
emergencies, safety-critical work or your only copy of important information.
* No promise is made about support, availability, compatibility, security,
recovery of accounts or continued development.
* Automatic checks contact boganpanda.com. Downloads can be disabled; installing
an update requires your action and may restart the app. Your Matrix account
data is not included in update requests.
* This is a permission to use the application, not an open-source license.
Third-party software, artwork and sounds keep their own licenses and rights.
* Nothing in this agreement removes rights or remedies that the law does not
allow to be excluded, including applicable Australian Consumer Law rights.

This summary helps explain the agreement but is not a separate agreement.
The full terms below control if the summary and full terms are inconsistent,
subject always to non-excludable law. Read the full terms before accepting.

FULL TERMS

1. Parties, scope and acceptance
"Publisher", "we" and "us" mean the publisher of Rift Chat identified by the
website boganpanda.com. "You" means the person using the application. These
terms apply to the Publisher's Rift Chat binaries and accompanying materials
(the "Software"). Accepting in the installer or in the Software records your
agreement. If you do not agree, cancel installation and do not use the Software.
The domain name is the Publisher's public identifier, not a representation that
the domain is a separately incorporated legal person. Contact the Publisher
through boganpanda.com regarding these terms.

2. Limited permission and ownership
Subject to these terms, the Publisher grants you a non-exclusive, worldwide,
royalty-free permission to install and use official copies of the Software for
personal or internal business purposes and to make reasonable backup copies.
Ownership is retained by the relevant rights holders. Except as required by
applicable law or a separate license, these terms do not grant permission to
redistribute, sublicense, sell, modify or reverse engineer Publisher-owned
components. No open-source rights are granted by these terms. Any future source
release is governed by the license accompanying that release; it does not
retroactively change this agreement unless expressly stated.

3. Third-party components and services
Third-party components are governed by their own licenses, supplied in the
Software's attributions and notices. Those licenses take precedence for those
components; these terms do not restrict rights those licenses grant you.
Matrix homeservers, media hosts, GIF providers and linked sites are independent
services governed by their own terms. The Publisher does not operate, endorse
or guarantee them merely because the Software connects to them.

4. Your responsibilities and security
You are responsible for lawful use, your devices, access permissions, accounts,
content, backups, passwords and recovery keys. Encryption does not guarantee
protection against every attack, compromised endpoint or user error. Verify
recipients and devices and keep independent recovery material. Do not rely on
the Software for emergency communications, medical or safety-critical decisions,
or as the sole store of important data. These responsibilities do not transfer
to you liability that cannot lawfully be transferred.

5. Updates and changes
The Software may check boganpanda.com for version information and download a
signed update in the background. You can disable automatic downloads and check
manually. Update requests disclose ordinary connection information, including
IP address and software/platform information, but do not send your Matrix
credentials, message history or encryption keys. Installation requires your
action and may restart the Software. Updates can fail or change functionality.
There is no obligation to provide updates, fixes, compatibility or support.
Materially changed agreement terms require affirmative acceptance before an
update governed by those terms is installed; continued use alone does not
silently accept revised terms. Declining an update leaves your existing version
subject to its existing terms, although external services may stop supporting it.

6. No voluntary warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS",
"WHERE IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT EXPRESS OR IMPLIED
WARRANTIES OR CONDITIONS, INCLUDING MERCHANTABILITY, ACCEPTABLE QUALITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. THE PUBLISHER
DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, SECURITY, ACCURACY,
COMPATIBILITY, DELIVERY OR RETENTION OF MESSAGES, OR RECOVERY OF ACCOUNTS OR
DATA. NO VOLUNTARY WARRANTY IS CREATED BY INFORMAL SUPPORT OR DOCUMENTATION.
THIS CLAUSE DOES NOT EXCLUDE A WARRANTY OR GUARANTEE THAT CANNOT LAWFULLY BE
EXCLUDED, OR AUTHORISE A MISLEADING STATEMENT ABOUT YOUR RIGHTS.

7. Allocation of risk and limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ASSUME THE RISKS OF INSTALLATION
AND USE, AND THE PUBLISHER AND CONTRIBUTORS ARE NOT LIABLE FOR LOSS ARISING
FROM THE SOFTWARE, INCLUDING LOST DATA OR MESSAGES, ACCOUNT ACCESS, PROFITS,
BUSINESS INTERRUPTION, OR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS,
WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANOTHER LEGAL THEORY,
EVEN IF ADVISED OF THE POSSIBILITY. WHERE LIABILITY MAY LAWFULLY BE LIMITED
BUT NOT EXCLUDED, THE PUBLISHER'S AGGREGATE LIABILITY IS LIMITED TO AUD 100.
THESE EXCLUSIONS AND LIMITS DO NOT APPLY TO FRAUD, WILFUL MISCONDUCT, OR ANY
LIABILITY OR REMEDY THAT APPLICABLE LAW DOES NOT ALLOW TO BE EXCLUDED OR LIMITED.
THIS AGREEMENT DOES NOT REQUIRE YOU TO INDEMNIFY THE PUBLISHER FOR ITS CONDUCT.

8. Non-excludable rights
Nothing excludes, restricts or modifies any statutory guarantee, right, remedy
or liability to the extent prohibited by applicable law, including the
Australian Consumer Law. Where such rights apply, you retain the remedies
available under that law. Read every disclaimer, risk allocation and limitation
in this agreement subject to this clause. If a limitation is not lawful in your
jurisdiction it does not apply to that extent; it does not cancel your rights.

9. Ending use
You may end this agreement by stopping use and deleting Publisher-owned copies,
subject to lawful retention of backups or records. The Publisher may terminate
the permission in clause 2 for a material breach not remedied within 30 days
after written notice. Termination does not authorise remote deletion of your
account, messages, recovery keys or other personal files. Clauses concerning
ownership, third-party rights, disclaimers, liability and statutory rights
survive to the extent necessary.

10. Interpretation and governing law
The full terms take precedence over the introductory summary. If a provision
is unenforceable, it is severed only to the necessary extent and the rest
continues. Queensland, Australia law governs, subject to mandatory consumer
protections and any rights to bring proceedings in your local jurisdiction.
These terms do not impose an exclusive forum contrary to those rights.

Copyright in Publisher-owned components is reserved. See ATTRIBUTIONS.txt and
THIRD_PARTY_NOTICES.md for components supplied under separate licenses.
